Agreement between User and www.SBB-Team.com
Welcome to www.SBB-Team.com. The www.SBB-Team.com website (the "Site") is comprised of various web pages operated by SBB Team, LLC ("SBB Team"). www.SBB-Team.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.SBB-Team.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference. www.SBB-Team.com is an E-Commerce Site.
SBB Team provides health and wellness devices and services for users to make life altering changes. SBB Team sells The Arc Wave, whole body vibration platform, that significantly improves quality of life for all of users. SBB Team also provides Arc Wave online training on a monthly subscription for users to purchase for classes and techniques. Nutritional Consultations and Virtual Personal Training are also available to purchase.
Privacy Your use of www.SBB-Team.com is subject to SBB Team's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications Visiting www.SBB-Team.com or sending emails to SBB Team constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Cancellation/Refund Policy You may cancel your Arc Wave Training subscription at any time with no penalty. Any cancellations made after 30 days of service will not qualify for a refund on the Arc Wave or Arc Wave Training Subscription. Consultations are non- refundable.
Subscription Requirements To enjoy full access to the Arc Wave Subscription, you must register as a member of the ARC WAVE Subscription and enter into a subscription agreement for access to our live and on-demand classes, one-on-one training sessions with a personal trainer, content and features (a “Subscription”). Your Subscription is governed by the Subscription Terms and Conditions. You must provide complete and accurate registration information to SBB Team when signing up for a Subscription, complete the Subscription process, and notify us if any of your information changes.
Profile Information and Picture You may not use someone else's name, or any name, location or other public profile information (including your picture) that violates any third party rights or that is offensive, obscene or otherwise objectionable (in SBB Team’s sole discretion).
Account Security You are responsible for all activity that occurs under your account, including any activity by unauthorized users. You must safeguard the confidentiality of your password, and if you are using a device that others have access to, log out of your account after using the SBB Team Services. If you become aware of an unauthorized access to your account, change your password and notify us immediately at stephenn@sbbteam.com.
Subscription and Fees Team will provide information on our then-current Subscription requirements on the SBB Team Site and/or by other means through the SBB Team Service. Features and prices are subject to change.
Sales and Delivery of Product SBB Team accepts orders for the SBB Team equipment, including the Arc Wave and other accessories that may be offered through the SBB Team Site. Unfortunately, availability of products cannot be guaranteed. Unless otherwise specified at the time of purchase, you must pay for products when you place the order. All products ordered will be delivered to the U.S. shipping address you provide. We may cancel an order placed by you at any time and for any lawful reason prior to our delivery of the product(s) and receipt of payment in full from you, provided that we will refund any fees that you prepaid for those products. We may send an acknowledgment of receipt of your order and/or proof of purchase information through the SBB Team Site or to your email address after your payment has been processed. Please see our Warranty and Return Policy for further information about the SBB Team’s products.
If you are not purchasing the Arc Wave for use by residents in a single household, and are instead purchasing The Arc Wave Service on behalf of or for the benefit of a commercial entity and its customers, residents or other users at a single physical location (e.g., a gym, hotel, or apartment, condo or similar building), you will be deemed and considered a “Commercial Buyer”). If you are a Commercial Buyer, in addition to this Agreement, your purchase of the Arc Wave (including the Device and Subscription) is governed by the Commercial Program. The Commercial Program may require Commercial Buyers to purchase a Commercial Subscription, depending on the number of unique users that may access the Arc Wave Service you have purchased. If you violate the terms of the Commercial Program or this Agreement (including the Subscription Terms and Conditions), the Limited Warranty will be automatically voided and ARC WAVE may suspend, disable, or delete your account and your (and the users accessing the Arc Wave Subscription under your account) ability to access the ARC WAVE subscription.
Any attempt to repair the Device creates a risk of injury and property damage. YOU ACKNOWLEDGE AND AGREE THAT SBB TEAM IS NOT RESPONSIBLE OR LIABLE FOR ANY INJURY OR DAMAGE INCURRED DURING, OR AS A RESULT OF, ANY REPAIR OR ATTEMPTED REPAIR OF A DEVICE BY ANYONE OTHER THAN A CERTIFIED ARC WAVE TECHNICIAN. ANY REPAIR OR ATTEMPTED REPAIR BY YOU OR YOUR AGENTS ARE UNDERTAKEN AT YOUR OWN RISK AND ARC WAVE WILL HAVE NO LIABILITY FOR ANY INJURY TO PERSONS OR PROPERTY ARISING FROM SUCH REPAIRS OR ATTEMPTED REPAIRS. IN ADDITION, ANY REPAIR OR ATTEMPTED REPAIR BY ANYONE OTHER THAN A CERTIFIED SBB TEAM TECHNICIAN VOIDS THE LIMITED WARRANTY.
Term This Agreement begins on the date The Arc Wave is delivered and continues as long as you have an account with us and/or continue to use the ARC WAVE Subscription.
Termination for Breach SBB Team may, in SBB Team’s sole discretion, suspend, disable, or delete your account (or any part thereof) or block or remove any User Content (defined below) that you submitted if SBB Team determines that you have violated this Agreement or that your conduct or User Content would tend to damage SBB Team’s reputation and goodwill. If SBB Team deletes your account for these reasons, you may not re-register for or use the ARC WAVE Subscription under any other user name or profile. SBB Team may block your access to the ARC WAVE Subscription to prevent re-registration.
Effect of Termination / Account Deletion Upon termination of this Agreement all licenses granted by SBB Team will terminate. The following sections survive termination: Submissions, Indemnification, Limitation of Liability, Professional Advice Disclaimer, Medical Disclaimer, Intellectual Property and all General Provisions. If your account is deleted for any reason, User Content may no longer be available and SBB Team is not responsible for the deletion or loss of such User Content. For clarity, if you cancel your Subscription or it is terminated for any reason, you will lose access to all live and on-demand classes, one-on-one personal training sessions, and any other content or features provided through the ARC WAVE Subscription. SBB Team, in our sole discretion, may make available a very limited amount of content or features to non-subscribers from time to time.
Submissions Any video, image, graphics, photos, text, audio recording, content, materials, information or other works that is submitted to the ARC WAVE Subscription by or on behalf of users (“User Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. You represent that all User Content submitted by or on behalf of you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations. You acknowledge that all content, including User Content, accessed by you using the ARC WAVE Subscription is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. We make no representations, warranties or guarantees with respect to any content that you access on or through the ARC WAVE Subscription.
As between you and SBB Team, you own all User Content that you submit to the ARC WAVE Subscription. You grant SBB Team worldwide, perpetual, irrevocable, non-exclusive, sublicensable (through multiple tiers), transferable, royalty-free license and right to use, copy, transmit, distribute, publicly perform and display (through all media now known or later created), edit, modify, and make derivative works from your User Content for any purpose whatsoever, commercial or otherwise, without compensation to you. In addition, you waive any so-called “moral rights” or rights of privacy or publicity in your User Content. You further grant all users of the ARC WAVE Subscription, including personal trainers (if applicable), permission to view and use your User Content for their personal, non-commercial purposes, or for purposes relating to your personal training sessions (if applicable). If you make suggestions to SBB Team or through the ARC WAVE Subscription about improving or adding new features or products to the ARC WAVE Subscription or you otherwise provide feedback or testimonials, SBB Team worldwide, perpetual, irrevocable, non-exclusive, sublicensable (through multiple tiers), transferable royalty-free license and right to use your suggestions, feedback and testimonials without any compensation or other obligation to you.
Content Restrictions You may not upload, post, submit, distribute or transmit (collectively, “submit”) to any portion of the ARC WAVE Subscription any User Content that:
Infringes any third party's copyrights or other rights (e.g., trademark, privacy rights, etc.);
Contains sexually explicit content or pornography;
Contains hateful, defamatory, or discriminatory content or incites hatred against any individual or group;
Exploits minors;
Depicts unlawful acts or extreme violence;
Depicts animal cruelty or extreme violence towards animals;
Promotes fraudulent schemes, multi-level marketing (MLM) schemes, get rich quick schemes, online gaming and gambling, cash gifting, work from home businesses, or any other dubious money-making ventures; or
Violates any law.
Code of Conduct In using the ARC WAVE Subscription, you must behave in a civil and respectful manner at all times. In addition to the restrictions in Sections 9 and 2, you will not:
Act in a deceptive manner by, among other things, impersonating any person;
Harass or stalk any other person;
Harm or exploit minors;
Distribute "spam";
Collect information about others;
Advertise or solicit others to purchase any product or service;
Engage in any conduct that is offensive or illegal; or
Violate any other community rules or codes of conduct that ARC WAVE may impose.
SBB Team has the right, but not the obligation, to monitor all conduct on and content submitted to the ARC WAVE Subscription. SBB Team may alter, edit, remove, or refuse to post any content, software and/or applications, in whole or in part, in SBB Team’s sole discretion or to satisfy or comply with applicable laws, regulations, legal processes and/or maintain the integrity and reputation of the ARC WAVE Subscription and SBB Team’s systems.
Children Under Thirteen SBB Team does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.SBB-Team.com only with permission of a parent or guardian.
Links to Third Party Sites/Third Party Services www.SBB-Team.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of SBB Team and SBB Team is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. SBB Team is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by SBB Team of the site or any association with its operators.
Certain services made available via www.SBB-Team.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the www.SBB-Team.com domain, you hereby acknowledge and consent that SBB Team may share such information and data with any third party with whom SBB Team has a contractual relationship to provide the requested product, service or functionality on behalf of www.SBB-Team.com users and customers.
No Unlawful or Prohibited Use/Intellectual Property You are granted a non-exclusive, non-transferable, revocable license to access and use www.SBB-Team.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to SBB Team that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of SBB Team or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. SBB Team content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of SBB Team and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of SBB Team or our licensors except as expressly authorized by these Terms.
Third Party Accounts You will be able to connect your SBB Team account to third party accounts. By connecting your SBB Team account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
International Users The Service is controlled, operated and administered by SBB Team from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the SBB Team Content accessed through www.SBB-Team.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification You agree to indemnify, defend and hold harmless SBB Team, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. SBB Team reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with SBB Team in asserting any available defenses.
Class Action Waiver Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and SBB Team agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Liability Disclaimer THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. SBB TEAM, LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
SBB TEAM, LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. SBB TEAM, LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SBB TEAM, LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SBB TEAM, LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction SBB Team reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Texas and you hereby consent to the exclusive jurisdiction and venue of courts in Texas in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and SBB Team as a result of this agreement or use of the Site. SBB Team's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of SBB Team's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by SBB Team with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and SBB Team with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and SBB Team with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms SBB Team reserves the right, in its sole discretion, to change the Terms under which www.SBB-Team.com is offered. The most current version of the Terms will supersede all previous versions. SBB Team encourages you to periodically review the Terms to stay informed of our updates.

At SBB Team, protecting your private information is our top priority.
This Statement of Privacy applies to www.SBB-Team.com and SBB Team, LLC and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to SBB Team, LLC include www.SBB-Team.com and SBB Team. The SBB Team website is an ecommerce site. By using the SBB Team website, you consent to the data practices described in this statement.
Collection of your Personal Information
SBB Team collects Personal Information from its current, prospective, and former customers, members, users, visitors, and guests (collectively "Individuals").
Information You Provide Directly to Us
When you use the Services, contact us directly, or engage in certain activities, such as registering for an account with SBB Team, purchasing SBB Team products or Services from us, using our fitness equipment or participating in a studio class live or via our subscription services, we may ask you to provide some or all of the following types of information
Purchases When you choose to purchase SBB Team products or Services from us including fitness equipment and accessories, apparel, live in-studio classes or subscription services offered through any device, we may collect information from you including Personal Information, such as your name, email address, mailing address, phone number, payment information, such as a credit card number and/or other related information that may be required from you to complete your purchase (such payment information, "Financial Information"). Unless we tell you otherwise at the time of your purchase or application for financing, your Financial Information is Processed by our third party processors and we do not collect, store or maintain your Financial Information. For more information on how your information is shared in these instances, please see Section 3.5 ("Third-Party Payment Processing") below. We will also collect a username and password in connection with any account created via the Services.
Public User Profiles When you use SBB Team fitness equipment (ARC WAVE) or participate in the ARC WAVE Subscription, you will be given the opportunity to create a “User Profile” and when you do so we may ask you to provide information about yourself such as a username, email address, weight, height, age, location, birthday, phone number and image. Only your email address and username are required to set up a User Profile; the rest of the information that you may provide is optional.
Once your User Profile is created, anytime you log in to participate in a studio class in-person or via our subscription service, we will collect additional information and add it to your User Profile and any other information that may be available from time to time.
You acknowledge that your User Profile information may be personal to you, and by creating an account and providing such information through the use of our Services, you allow others, including SBB Team, to identify you and therefore you may not be anonymous. Information included in your User Profile, including any achievements, milestones, streaks or badges earned via the Services may be displayed on in-studio digital signage if you come to a live class at any of our studios.
Voice and Likeness We may capture your visual image, likeness and voice recording (e.g., via photographs and/or video) if you visit our studios and/or showrooms, participate in studio classes and/or call our member support or inside sales teams. We record and store member support and sales calls to train support and sales agents to help resolve member questions, for quality purposes and as required by law. Additionally, SBB Team fitness equipment and the SBB Team App may contain a camera, microphone and voice control features. These features are in use only when activated by you, for example, to take a SBB Team user profile photo or to initiate or accept a video chat from another user.
Other User Information SBB Team may also collect other information from you as a result of your use of the Services, such as in-studio attendance history, purchase history, fitness and health related information. We may associate this information with other Personal Information that you have provided in order to improve and provide the Services and as otherwise described in this Privacy Policy.
Communications with Us We may collect Personal Information from you such as your email address, phone number or mailing address, when you choose to request information about our Services, visit our retail showrooms, register to receive SBB Team communications over email or text messaging, participate in promotions, or loyalty programs that we may offer from time to time, request to receive member or technical support or otherwise communicate with us.
Surveys and Reviews From time to time, we (or third parties acting on our behalf) may contact you to participate in research, surveys or beta testing or to provide reviews and testimonials. If you decide to participate, you may be asked to provide certain information, which may include Personal Information. All information collected from your participation in our research, surveys, reviews or testimonial process, or beta testing is provided by you voluntarily. We may use such information to improve our products, our Site and/or Services, and in any manner consistent with this Privacy Policy.
Posting on the SBB Team or Third Party Services SBB Team may offer publicly accessible blogs, social media pages, product review pages, private messages, video chat or community forums. You should be aware that, when you disclose information about yourself on SBB Team’s blogs, social media pages, product review pages, private messages, community forums, and within video chat sessions, SBB Team will collect the information you provide in such submissions, including any Personal Information. If you choose to submit content, including reviews, to any public area of the Services or on any public sites operated by third parties, such content will be considered “public” and will not be subject to the privacy protections provided in this Privacy Policy.
Registration for Sweepstakes or Contests Occasionally, SBB Team may run sweepstakes and contests. We ask those who enter sweepstakes or contests to provide contact information (e.g., a phone number or an email address). If you participate in a sweepstakes or contest, your contact information may be used to reach you about the sweepstakes or contest, and, to the extent permitted by law, for other promotional, marketing and business purposes. In compliance with the laws of your jurisdiction, as a participant you may have the opportunity to opt-out of any communications that are not related to awarding prizes.
Location Information Based on your interaction with the Services, the type of device you use to access the Services, and your device’s connectivity, we may collect location-based information including your Internet protocol (IP) address, GPS location, longitude/latitude, city, county, zip code and region, and your location and your smart device’s proximity to “beacons,” Bluetooth networks and/or other proximity systems. We may use this type of information to enhance your user experience (such as using location information for the purposes of displaying the geographic distribution of SBB Team workouts on a heat map), to better understand your interaction with our products and services in our showrooms, or to enable you to track your outdoor fitness activities. Unless you provide us with your consent to do otherwise, this information will only be used by us and our third party service providers to provide you with the Services you request or in an aggregated and anonymized format that does not identify you.
